ChemNutra Says Menu Foods Got More Wheat Gluten Elsewhere

Itchmo has learned that ChemNutra, the US importer of tainted wheat gluten, was searched by the FDA. The most shocking part of this release is that ChemNutra says: “Menu Foods used significantly more wheat gluten monthly than we supplied to them, so we hope that Menu Foods will disclose its other sources to the FDA.”

We’ll let that sink in a little. Just to let you know, Menu Foods sued ChemNutra earlier in the day.

ChemNutra Offices Searched by FDA

Las Vegas – April 26, 2007 — The U.S. Food & Drug Administration (FDA) today conducted a search of ChemNutra’s offices in Las Vegas, NV, as part of a misdemeanor investigation into whether the Federal Food, Drug & Cosmetic Act has been violated.

ChemNutra’s officers have been informed that, under the legal doctrine of “strict liability,” the company could be held accountable because it imported the melamine-adulterated wheat gluten that is one reason for the current pet food recalls, even though the company had no prior knowledge, or reason to believe, that its Chinese supplier had put melamine in the product.

Steve Miller, Chief Executive Officer of ChemNutra, said “We have cooperated and complied fully with FDA investigators both prior to and since being served with today’s search warrant, and will continue to do so. We keep very good records which has made it relatively easy for the investigators to retrieve what they needed.” He added that, “We also now believe that our wheat gluten customer, Menu Foods, used significantly more wheat gluten monthly than we supplied to them, so we hope that Menu Foods will disclose its other sources to the FDA to ensure that any suspect product is quarantined.

“We placed our wheat gluten in quarantine as soon as Menu Foods informed us that it might have contributed to pet illnesses about which Menu Foods had apparently been aware for some time. We can only hope that Menu Foods has taken steps to ensure that this situation will not be allowed to spread even farther because of its inaction.”

    Well, while we are all looking for someone to blame - it was MENU FOODS that stonewalled on recalling the first time.

    ChemaNutra was informed by Menu something was wrong with the wheat gluten on March 8th - a week prior to turning any info over to the FDA in regards to the pet food. ChemNutra quarentined the remaining product, and recalled further when FDA made mention of the Melamine.

    MenuFoods has had to reimburse Grocers/Retailers for their product. Menufoods had lousy earnings, and was dying financially through last summer - than began to beef those profits up how? By ordering ALL THEIR GLUTEN FROM CHINA!!

    Menu is trying to hurry the blame off themselves, to deflect all the class action suits coming their way. This is a known practice (they started perparing for this - with much more foresight - than they did about getting their food off the shelves). This of course, can be verified with the COINCEDENTAL TIMING OF SELLING THE STOCK.

    That company, its PR and its lawyers have the ethics and credibility of a latter-day Josef Mengele. What they are doing is looking more and more like running up a test flag for a US pet and - possibly human - extermination program. Transparency and accountability used to be corporate values, but in their book, mass puppy killing seems to give them their juice.
